L1签证是由美国跨国公司为其外籍高级管理人员和行政人员的长期居留申请而提出的移民签证申请。 L-1A允许海外分公司或子公司的雇员在美国进行商业活动,并帮助申请人从海外到美国工作。持有L-1A签证的外国公民可以在美国工作、生活和定居,没有限制,并且可以携带配偶和孩子一起进入美国。如果海外公司被授权为母公司,则L-1A身份可以是永久性的。
对于L-1A持有人来说,他们通常拥有学士学位以上的学历,而且通常具有至少5年的管理经验(管理职位)。 大多数L-1A持有人年龄在21至45岁之间,且最近在本科或以上学历,并且过去三年的收入达到所在国家中位的两倍左右。
L-1 visa分为两类,L-1A and L-1B
L-1A for managers/executives, usually with a degree or above , at least five years of work experience in management position.
L-1B for specialized knowledge workers, usually have bachelor's degrees as minimum requirement , more than one year working experiences in the special field they possess their unique specialty.
The first step is to apply an EB-1C I-129 petition by your employer on behalf you, this application requires evidence that proves your job title (manager / executive), employment period, salary etc. The evidence required could include but not limit to: corporate documents, paystubs, performance appraisal, business cards... Generally speaking , employers need to provide supporting evidences about you and your foreign company within last three years before the filing date of the I-129 petition. And these are called the “pre-pending period”. It means if the employer cannot satisfy these requirements, his/her petition will be rejected because it does not meet “continuous physical presence criteria“(the so-called “212(e)” regulation. As we know from USCIS policy bulletin, April 2016 , most cases were filed under pre-2013 regulations which require only two out of six months continuous residence during the past three years rather than four consecutive years since the first admission. So basically, our advise still applies: use post-April 2013 guidance when possible. That way you can get higher approval rate while avoiding being subjected to unnecessary administrative proceedings.
